Legal Takeaways with Gosschalks Solicitors Construction Law team

On 21st November 2019, the School of Built Environment, Engineering and Computing held a Legal Update seminar with it's Constructing Excellence Yorkshire and Humber network at Gosschalks Solicitors in Hull.

Attended by over 60 individuals, Gosschalks' Construction Law team gave the audience an interesting overview of some key cases as well as covering the topics of Practical Completion, “Smash & grab”, Oral Modification and drafting strategies. Here are some key takeaways from the event;

  • Termination has a significant impact on Liquidated Damages – and you need to ensure your contact is carefully drafted with express wording to achieve the outcome you desire. Amendments to even the standard forms will often be necessary.
  • Make sure your contract is joined up when it comes to Practical Completion. Are any material requirements linked to Completion, and is that linked to Termination? Is PC linked to a third party, and do your requirements line up with those in any subcontracts?
  • Smash and Grab adjudication remains alive and kicking – make sure your payment provisions are carefully drafted, and your practices in order, to protect you from paying over the odds.
